Chapter 1 General Rules

This is a guide to help users understand the entire terms and conditions, including the purpose of these terms and conditions.

Article 1 (Purpose)

These terms and conditions (hereinafter referred to as “Terms and Conditions”) are intended to stipulate the conditions, procedures, and requirements of “COVID-19 CheckUp (hereinafter referred to as “Service”)”. It is provided by Doctor on the Cloud CO., Ltd. (hereinafter referred to as “DOCL”)

Article 2 (Notice and Effect of the Terms and Conditions)

① DOCL notifies Terms and Conditions through the screens provided within the app or the website (hereinafter referred to as “application screen”).
② DOCL will answer any questions users have about the Terms and Conditions.
③ DOCL may amend the Terms and Conditions to the extent not to violate related laws, such as the “Information and Communication Network Utilization Promotion and Information Protection Act”.
④ Agreeing to the Terms and Conditions means that users agree to visit the Service regularly to confirm any changes to the Terms and Conditions. DOCL is not responsible for any damage caused by not recognizing the changed Terms and Conditions.
⑤ If DOCL revises these Terms and Conditions, we will clearly notify the current Terms and Conditions, revised Terms and Conditions, the date of application of the revised version, and the reasons for the revision 7 days before application. And if the revised content is essentially important to the users, it will be notified by the method under paragraph 1 from 30 days before application.
⑥ If the user disagrees with the application of the revised Terms and Conditions, the user can terminate and withdraw the Service use contract.

Article 3 (Definition of Terms)

① The definitions of terms used in the Terms and Conditions are as follows:
A. Service(s): All services provided by DOCL that can be used by users on all possible devices such as PCs, smartphones, table, etc.
B. User(s): All customers who use this service(s).
C. E-mail address: An e-mail address determined by the user for user identification and service use and consists of a combination of letters and numbers approved by DOCL.
D. Password: A combination of letters and numbers determined by the user to ensure that the user matches the user’s e-mail address and to protect confidentiality.



Chapter 2 Service Contract

This is a guide to help users understand the situations that may occur when service contract.

Article 4 (Establishment of a Service Contract)
To complete service contract, the user must agree to the Terms and conditions, enter all necessary inputs, and apply for service use. The service contract is completed by DOCL approving the user’s application for service use.

Article 5 (Information for Service Contract Application)

① To use the service, user must enter the information requested by the DOCL.
A. Common: E-mail address, password, name (legal)
B. Physician’s app: E-mail address, password, name (legal), country, institution
② After logging in to the service, user must agree to DOCL research ethics and data collection.
③ Users’ e-mail address that includes other users’ e-mail address or personal information may be deleted or legal action may be taken to the user under related laws.
④ To improve user convenience and protect personal information, DOCL check the identity of the user only by e-mail address and password but omits resident registration numbers, public certificates, or real-name authentication. If an existing user registers with DOCL, it may be recognized as a duplicate application.

Article 6 (Acceptance of the Service Contract Application)

① If the user enters the information under Article 5 (1) and (2) and agrees to the Terms and Conditions and Privacy Policy, DOCL automatically approves the use of the service.
② DOCL may refuse to accept any of the following applications:
A. In the case where the user falls under the problem of Article 5 (3).
B. In the case of intentional or negligence in the matters stated under Article 5 (1) and (2).
C. In a case where the user disagrees with Terms and Conditions and the Privacy Policy.
D. Where measures are required under relevant laws and regulations.
③ However, if DOCL restricts the user’s application for service use pursuant to (2) of this Article, DOCL must give the user an opportunity to correct or explain it.

Article 7 (Privacy Policy)

① DOCL strives to protect users’ personal information in accordance with relevant laws and regulation.
② DOCL complies with the Privacy Policy prescribed by DOCL and relevant laws regarding the protection of users’ personal information. However, DOCL is not responsible for information disclosed due to reasons attributable to the users, except in cases where DOCL has intentional or gross negligence.



Chapter 3 Duties and Responsibilities

This is guide to the DOCL and the users’ obligations when using services.

Article 8 (Obligations of DOCL)

① DOCL does not engage in prohibited or unfavorable acts and does our best to provide continuous and stable services as prescribed by relevant laws and Term and Conditions.
② DOCL does not send advertising e-mails for profit that user do not want.
③ DOCL must file complaints from users through e-mail, etc. If the opinions or complaints raised by the user are objectively valid, they will be handled immediately. However, if it is difficult to process them immediately, DOCL should notify the user of the reason for the delay in processing and the processing schedule.
④ For safe use of the service, DOCL does not leak or distribute personal information to others without their consent in accordance with the Privacy Policy set by DOCL.
⑤ For the protection of users’ personal information and safe use of services, DOCL establishes and discloses and complies with the Privacy Policy set by DOCL

Article 9 (Obligations of the Users)

① Without the explicit consent of DOCL, the user’s right to use is limited to individuals and cannot be transferred, donated, or provided as collateral.
② Users are not allowed to perform the following actions when using the service:
A. Entering false information or using the personal information of another person when applying for service contract or modifying information.
B. Infringing on the right or copyrights of a third-party.
C. Business activities such as selling goods or services using DOCL services.
D. Illegal distribution of software, hacking into obscene sites, advertising, or promoting them.
E. Impersonating an employee or executive of DOCL.
F. Defaming DOCL or third-party.
G. Interfering with the official provision of services by DOCL or third-party.
H. An act that is objectively judged to be related to a crime.
I. Violation of other regulations or term and conditions prescribed by DOCL, including this Terms and Conditions.
J. Other acts in violation of relevant laws and regulation.
③ Since data provided by DOCL is flexible, users of Physician’s app can only use this data as research purposes and a supplement to establish treatment plans. However, the scope of use can be expanded in the future through sufficient data, other studies, comparison with existing treatment guidelines, and statistical analysis. The use of DOCL data for commercial purposes is strictly prohibited, and violation of this may result in legal action under the relevant laws.



Chapter 4 Service Use

This is a guide to help users understand the situation when using the service.

Article 10 (Service Hours)

① In principle, the service is open 24 hours a day. However, the service may be suspended for a period set by DOCL due to systems inspection, expansion, replacement, or other specific reasons. In this case, DOCL notifies the user in advance or after service suspended.
② DOCL may temporarily or permanently suspend services after prior notice or without notice in any of the following cases:
A. In the event of an emergency system inspection, extension, replacement, failure, or malfunction.
B. In a case of unavoidable reasons such as national emergency, power outage, natural disaster, etc.
C. In a case where excessive service use interferes with the service provision.
③ In the case of service interruption or suspension under the preceding paragraph, DOCL notifies the user in advance. However, prior notification may not be possible due to circumstances beyond DOCL’s control.

Article 11 (Modifying and Managing Personal Information)

① Registered e-mail addresses cannot be changed for personal reasons such as the user’s change of mind, except for technical problems such as duplicate registration of e-mail addresses due to system errors. If users need a change, users must delete the existing e-mail addresses and register a new e-mail address.
② The e-mail address of the user of this service may be linked to other users of DOCL’s other services with the consent of the user.
③ The users are responsible for damages caused by the user neglecting their e-mail addresses and passwords or unauthorized transfer or rental, so the users should be extra careful.
④ If the user recognizes that their e-mail address or password has been stolen, user must immediately notify DOCL and protect their information and rights according to DOCL’s guidance.
⑤ If the user’s e-mail address overlaps and it is difficult to provide services, DOCL may request a change of e-mail address to the user. In addition, e-mail addresses can be changed collectively by not changing the essential parts according to site integration and important policy changes in DOCL. In this case, DOCL notifies the user of the change.



Chapter 5 Compensation for Damages and Other Matters

This is guide to the scope of the DOCL and the user’s responsibility when using the service.

Article 12 (Compensation for Damages, etc.)

① DOCL does not provide legal guarantees for matters not specified in the Terms and Conditions regarding the service. In addition, DOCL does not guarantee the reliability, accuracy, etc. of information, data, facts, or illegality posted by the founder or user on the service and is not liable unless there is intentional or gross negligence by DOCL.
② If the user suffers damage due to reasons attributable to DOCL, DOCL shall compensate the user for damages as prescribed by the Terms and Conditions. However, DOCL is not responsible for the following damages:
A. DOCL is not responsible for definitive medical practices base on DOCL data. As specified in Article 9 (3), DOCL’s data can only be used as purposes of research and supplementary to establish treatment plans.
B. DOCL is exempt from liability if it is unable to provide services due to natural disaster, wars, or another force majeure equivalent thereto.
C. DOCL is exempt from liability in the event of damage caused by a telecommunication business operator suspending or not providing telecommunication services normally.
D. DOCL is exempt from liability for damages caused by unavoidable reasons such as repair, replacement, regular inspection, and construction for service facilities unless intentional or gross negligence occurs.
E. DOCL shall not be liable for any failure or damage caused by the user’s attribution, except in the case of cases of intentional or gross negligence of DOCL.
F. DOCL shall not be liable for damages caused by a user’s computer error or for insufficient entry of the user’s personal information and e-mail address.
G. DOCL is not responsible for the failure or loss of profits expected by users using the service.
H. DOCL shall not be liable for damages caused by the data obtained by the user using the service, except in the event of DOCL’s intentional or gross negligence.
I. DOCL is not responsible for compensating the user for mental damage caused by other users using the service.
J. DOCL is not obligated to intervene in disputes between users and third parties through the service and is not responsible for compensating for any damages caused by this.
③ In the event of damage to DOCL due to illegal activities and violation of the Terms and Conditions committed by the user, or if third party claims damages or various objections against DOCL due to user’s negligence, the user shall compensate the DOCL.

Article 13 (Provision of Information and Notification to Users, etc.)

① With the consent of the user, DOCL can provide various information that is deemed necessary to use the service through e-mail or application screen.
② If more than 10 data are registered by medical staff participating in the DOCL, DOCL may need to analyze the data for further research. However, the above “more than 10 data” is limited to cases where all items are fully registered regardless of the total number of patient registrations by the medical staff.
③ If the user falsely lists their personal information, the user may not receive important notifications from DOCL.

Article 14 (Jurisdiction and Governing Law)

① Laws of Republic of Korea apply to matters not specified in the Terms and Conditions.
② If a lawsuit is filed against a dispute arising from the use of the service, the court at the address under the Civil Procedure Act shall be the competent court.



Additional Clause

Article 1 (Effective Date)

① This Terms and Conditions will take effect in October 2021.

Article 2 (Designation of the Personal Information Management Manager)

① In order to protect users’ personal information and handle complaints related to personal information, DOCL designates a personal information management manager as follows.
